Terms and Conditions of Entry

These Terms and Conditions are the only information provided by the Promoter regarding the Promotion. Submission of an entry into this Promotion is deemed acceptance of these Terms and Conditions.

Competition opens 12 noon on June 13th 2016 and closes 12 noon on Tuesday July 12th 2016.  

Entry is open to all owners of residential property in the Brisbane suburbs nominated, specifically subject to the further terms below. The prize will be drawn by random manner and the winning Entrant notified by phone.

To enter Entrants must, during the Promotional Period, enter by submitting the entry form at beesnees.com.au including confirming the suburb of their nominated property and their name, telephone number and email address. Personal information disclosed is provided to the Promoter only and will not be shared with any third party. All Entrants expressly consent to their contact information being used by the Promoter to provide ongoing information on its services and the inner-Brisbane property market.

The Promoter reserves the right, at any time, to verify the validity of entries and Entrants (including an Entrant’s identity, age and property details) and to disqualify any Entrant who submits an entry that is not in accordance with these Terms and Conditions, who tampers with the entry process, or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. The Promoter reserves the right to disqualify an Entrant if the Promoter becomes aware that the Entrant and/or the Entrant’s entry is of a type described in this clause.

Entries submitted by any person licensed or registered in Queensland as a real estate agent or registered real estate salesperson will be invalid.

Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

Incomplete, indecipherable, or illegible entries will be deemed invalid. One entry per person is permitted.

Prizes will not be redeemable for cash.

Entrants consent to the Promoter using the Entrant’s name and property suburb in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome).

If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law to (a) disqualify any Entrant; or (b) to modify, suspend, terminate or cancel the Promotion, as appropriate.

Any cost associated with accessing the Promotional website is the Entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an Entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that Entrant invalid.

Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury or death, or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a user or Entrant; (f) the acceptance or use of a prize; (g) any act or omission of the Promoter or its associated agencies.

As a condition of accepting the prize, the Entrant (and all legal owners of the property) will be asked to sign any legal documentation as and in the form required by the Promoter in their absolute discretion, including annexing these Terms and Conditions to the agreement. The prize is intended to be an ongoing service provision by the Promoter and will require full and complete information on both the property and all legal owners, and execution of an appointment as real estate agent for the property owners. Entry is conditional on providing this information and doing all things necessary as Lessor to allow the Promoter to provide its usual property management services. The Entrant warrants that they and all legal owners of the property are legally able to enter into such an agreement and will comply with all obligations as Lessor.

The prize applies to one residential dwelling in the nominated suburbs only, usually the subject of a general tenancy agreement and excludes multiple dwellings, rooming accommodation, caravans and movable dwellings and short-stay accommodation. The Promoter reserves full and absolute rights to refuse to be appointed as property manager and execute an appointment of agent form if the Promoter, in its sole and absolute discretion, does not believe the property is safe, appropriate for renting as a residential dwelling or in any other way is not fit for residential tenants to occupy. This Promoter’s right to refuse the appointment to manage the property may include but not be limited to considerations on compliance with planning approvals, building codes, tenant privacy and safety.

The nominated suburbs are: Albion, Annerley, Ashgrove, Auchenflower, Balmoral, Bardon, Bowen Hills, Breakfast Creek, Brisbane City/CBD, Bulimba, Buranda, Clayfield, Coorparoo, Dutton Park, East Brisbane, Fairfield, Fortitude Valley, Greenslopes, Hamilton, Hawthorne, Herston, Highgate Hill, Hill End, Indooroopilly, Kangaroo Point, Kelvin Grove, Milton, Morningside, New Farm, Newmarket, Newstead, Norman Park, Paddington, Petrie Terrace, Red Hill, Rosalie, South Bank, South Brisbane, Spring Hill, St Lucia, Stones Corner, Taringa, Tenneriffe, The Gabba (Wooloongabba), The Valley, Toowong, West End, Wilston, Windsor, Wooloowin, Yeerongpilly, and Yeronga.

The Promoter requires the Entrant as lessor to have and maintain at all times all necessary policies of insurance including a policy (Landlord Insurance) that includes a minimum $20m public liability cover and cover for tenant default and malicious damage.

The Promoter undertakes to provide its usual property management services at no cost to the winning Entrant, but specifically does not undertake to provide further or broader services without charge. These further services will include items the Promoter typically charges additional fees to its lessor clients and will include, but not be limited to, tribunal preparation and appearances, property renovations, inventory preparation and management of furnished properties and additional inspections.

The Promoter undertakes to provide its property management services until the earlier of:

a)      The sale or transfer (partial or otherwise) of ownership of the property

b)      Damage or interference with the property by whatever cause including natural events, fire, lack of maintenance or malicious damage such that it is deemed unlivable or unsafe (in the sole and absolute discretion of the Promoter)

c)      The Entrant as lessor:

i.          setting an asking rent that is not in accordance with the reasonable recommendations of the Promoter, or

ii.          unreasonably (in the sole opinion of the Promoter) refusing to approve a suitable tenant, or

iii.          attempting to provide unlawful or unethical instructions to the Promoter or otherwise acting in an illegal or unethical manner

iv.          the property owners failing to provide the Promoter with clear instructions (including by way of dispute between the owners) when required

provided the Promoter has first given 7 days’ notice of its intention to terminate its appointment as agent.

d)      The sale or closure of the property management business of the Promoter including the issue or sale of shares in the Promoter such that an effective change in control of the business has taken place.
